According to the company’s 2024 Annual Impact Report, it has more than 43 million patient encounters annually, which means it works with a vast amount of data.
Unfortunately, that is where HCA Healthcare encountered a significant problem. In 2023, the company suffered a severe data breach as a result of a “criminal cyberattack.” The attack enabled the cyberattackers to obtain data of 3.6 million patients. This resulted in a data breach class action lawsuit, where plaintiffs argue that HCA Healthcare could have prevented the attack, preventing them from being at risk of identity theft and fraud.
HCA Healthcare denied all allegations but agreed to a settlement of an undisclosed sum to resolve all of the allegations.
Only these citizens will be deemed as class members
While HCA Healthcare may have millions of patient encounters annually, not all of them will qualify to claim from this settlement. According to Top Class Actions, only the following HCA patients will be deemed as class members of this settlement:
- HCA Healthcare patients residing in the U.S. and
- Whose data was breached in the data breach incident, which was announced on or about July 10, 2023
Having eligibility requirements is not uncommon, as could also be seen with this data breach class action settlement that paid out $5,000 to certain citizens. According to the official settlement website, class members can claim the following:
- One year of free credit monitoring and insurance services
- Cash payments up to $5,000 for documented losses
Documented losses include identity theft, fraudulent charges, back charges, credit expenses, etc. Documentation must be provided as proof to receive compensation.
Make sure you highlight this date
You will only receive benefits from this settlement if you filed a valid claim either online or by downloading a PDF form and submitting it via mail on or before the deadline, which is today, Thursday, September 25, 2025. The official payment date for the settlement benefits has not been communicated yet, as the settlement must still obtain final approval from the court.
Once final approval has been given and all possible appeals have been resolved, then the benefits will be distributed. The HCA Healthcare data breach settlements final approval hearing has been scheduled for October 27, 2025.
